Terms & Conditions

Welcome to MyScholar. By accessing our website, mobile application, or using our AI and tutoring services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.

These Terms constitute a legally binding agreement between you ("User", "Student", or "Tutor") and MyScholar (operated by CodeScape Zimbabwe).

1. Definitions

"Platform" refers to the MyScholar website and related services.
"Student" refers to a user seeking educational assistance.
"Tutor" refers to a user registered to provide educational services.
"Service" refers to live lessons, assignment assistance, resource downloads, and AI chat.
"Escrow" refers to the holding of funds by MyScholar until a service is successfully completed.

2. Accounts & Security

2.1. You must provide accurate and complete information during registration.

2.2. You are responsible for maintaining the confidentiality of your login credentials.

2.3. MyScholar reserves the right to suspend or ban accounts that violate these terms immediately.

3. Payments & Refunds

3.1. Payment Process

Assignments: Students must pay the full fee in advance. These funds are held in Escrow by MyScholar and are not released to the Tutor until the work is completed and approved.
Live Sessions: Lessons must be booked and paid for at least 24 hours in advance.

3.2. Platform Fees

MyScholar charges a service fee (commission) on all transactions. This fee is deducted from the Tutor’s earnings or added to the Student’s checkout total, depending on the specific service category.

3.3. Refund Policy

Assignments: A full refund is issued if the Tutor fails to deliver by the deadline. A partial refund may be issued if the work is significantly below the agreed standard (subject to Admin review).
Live Lessons: Refunds are only issued if the Tutor cancels or fails to attend.

4. Attendance & Cancellations

4.1. Student Cancellation

More than 24 hours notice: Full refund or free rescheduling.
Less than 24 hours notice: No refund. The Tutor is compensated for their reserved time.

4.2. Failure to Attend (No-Show)

Student No-Show: If a Student does not join the Microsoft Teams link within 15 minutes of the start time, the session is marked as "Completed," and the Tutor is paid in full.
Tutor No-Show: If a Tutor fails to join within 10 minutes, the Student must report it. The Student will be fully refunded, and the Tutor will be penalized.

5. Anti-Circumvention Policy

Strict Warning: Users are strictly prohibited from sharing personal contact details (phone numbers, email addresses, social media handles) within the chat, assignment files, or live sessions.

5.1. Off-Platform Payments: Asking a user to pay outside of MyScholar (e.g., via EcoCash, Innbucks, or direct transfer) is a serious violation.

5.2. Penalty: Our system monitors keywords. Any attempt to circumvent the platform will result in an immediate and permanent ban and forfeiture of any funds currently in the wallet.

6. Agreement with Tutors

By registering as a Tutor, you agree to the following:

Independent Contractor: You are an independent contractor, not an employee of CodeScape Zimbabwe. You are responsible for declaring your own taxes.
Quality of Service: You agree to provide high-quality, original work. Plagiarism in assignments will result in immediate termination.
Payouts: Tutor earnings are processed via the "Withdrawal" tab. Payouts are processed within 24-48 hours of the request.

7. Intellectual Property

7.1. Platform Content: All design, code, and graphics on MyScholar are the property of CodeScape Zimbabwe.

7.2. User Content: Resources uploaded to the "Resource Vault" remain the property of the uploader, but you grant MyScholar a non-exclusive license to display and distribute this content to other users.

8. Cookie Policy

MyScholar uses cookies to enhance your experience. By using our site, you consent to the use of cookies for session management (keeping you logged in) and analytical tracking to improve our services.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Zimbabwe. Any disputes arising from these terms shall be resolved in the courts of Zimbabwe.

10. Assignment Services

                 Important: MyScholar provides assignment assistance for reference and research purposes only.
            

10.1. Academic Integrity

Students agree not to submit work received from Tutors as their own academic work. MyScholar is not liable for academic penalties incurred by the Student.

10.2. Revisions

Students are entitled to one (1) free revision if the work deviates from the original instructions.
New instructions provided after the work is completed will attract an additional fee.

10.3. Approval

Once a Student marks an assignment as "Completed" or if 72 hours pass after delivery without a complaint, the funds are automatically released to the Tutor. No refunds are possible after funds are released.
